NEVERSEA 2025 GENERAL TERMS AND CONDITIONS

EVENT: NEVERSEA FESTIVAL

ORGANIZER: NEVERSEA S.R.L

LOCATION: Constanta Municipality, Constanta County, Romania

 

I. GENERAL PROVISIONS

1.1 The General Terms and Conditions (hereinafter TCG) apply to the organization and conduct of the Neversea event (hereinafter the Festival), organized by the company NEVERSEA S.R.L., having CUI RO36944344, and being registered in the Trade Register under no. J12/183/2017 (hereinafter the Organizer) and contain the provisions that each participant of the event undertakes to comply with.

1.2 By purchasing a ticket or participating in the festival, the Participant declares that he has read, understood and undertakes to comply with the TCG, which also includes the Privacy Policy.

1.3 The General Terms and Conditions are valid indefinitely. Participants agree that Neversea has the right to unilaterally modify these TCG without prior notice to them. If the TCG changes, those changes take effect immediately after publication on the Site. Neversea states that the TCG may be changed after the Ticket is purchased, even immediately prior to the Festival. Neversea recommends that Participants monitor any changes to these T&Cs.

 

2. DEFINITIONS 

2.1 As used herein, defined terms shall have the meanings set forth in this section, unless otherwise defined herein:

a) Ticket: a certificate issued in any form (on paper or in electronic form), one-day ticket, subscription or invitation certifying the right to a Wristband at the organized NEVERSEA Festival. Tickets are non-nominal or nominal and have a unique identification number. By purchasing Tickets, buyers undertake to comply with these General Terms and Conditions, the procedures for registering the purchased Tickets, the rules for check-in and access to the Festival, as well as any other rules for participating in it that are made known to them through various means , including directly through the Site. The purchase of Tickets/Wristbands from areas other than those authorized by the Festival Organizer is prohibited and leads to restricted access to the respective Festival.

b) Wristband: a certificate applied by Neversea when validating a Ticket, which offers rights identical to those included in the Ticket and - provided it is secured according to section 3 below - certifies exclusively that its bearer has the right to visit the respective Festival ; - a special payment instrument within the Festival.

c) Ticket Buyer: the person who buys the Festival Ticket.

d) Duration of the Festival: the duration of any Festival which will correspond to the time period between the beginning and the end of the Festival. The beginning of the Festival will correspond to the beginning of the validity of the tickets to that Festival which authorizes the first entry to that Festival. The end of a Festival will correspond to the end of the validity of the Ticket authorizing the longest stay at that Festival. Neversea reserves the right to organize programs or provide Services during the Festival.

e) Festival - The NEVERSEA Festival, consisting of all the performing arts programs – music, entertainment and culture – and other free or paid Services offered by NEVERSEA in a certain period of time and in a certain area established by the Organizer.

f) The Organiser/NEVERSEA – NEVERSEA SRL, with headquarters in the Municipality of Cluj-Napoca, 122A Eremia Grigorescu str., Cluj County, order number in the Trade Register J12/183/2017, unique registration code RO36944344.

g) Contractual Partner: an economic operator or other natural/legal person carrying out independent commercial activities at a certain Festival, based on a contractual relationship with Neversea.

h) Participants – all persons participating in the Festival.

i) Wallet - the section of the personal account created on the www.neversea.com platform where the user finds the purchased tickets, tickets available for check-in, tickets to past events and the possibility to check-in online or top-up tickets online.

j) Product: the items and rights with pecuniary value that can be purchased from Neversea or other Contractual Partners within the Festival or in connection with it, as well as any vouchers or other similar means that can be offered in exchange for them.

k) RHUNA - a multi-purpose voucher that can be used for the purchase of "Rhuna products and services", i.e. those available in the ecosystem of events and festivals organized by the Untold group of companies that include the Massif Festival, the Untold Romania Festival and Untold Dubai as well as the Neversea Festival. The purchase of RHUNA products and services is made from the platforms www.bemassif.com, www.untold.com, www.untold.ae, www.neversea.com. 

l) Rewards - benefits granted by the Organizer to customers to increase loyalty. These benefits and rewards can be used to purchase Rhuna products and services at festivals and platforms associated with the Untold group.

m) Service: any service made available by Neversea or its Contractual Partners within the Festival or in connection with it, either free of charge or for a fee.

n) Account Balance - the section of the personal account created on the www.neversea.com platform, where the user can load an amount of money. This amount is converted into Rhuna and can be used to purchase Rhuna products and services or to top up your festival access wristband online.

o) Website: the Neversea website, respectively www.neversea.com.

p) TCG – These General Terms and Conditions governing the conduct of the Festival, available both on the Website (as defined above) and at all entrances to the Festival Area.

q) Third parties: natural and legal persons other than Neversea, Visitors or Ticket Buyers.

r) Festival Area: any of the locations where the Festival takes place.

 

III.  LEGAL RELATIONSHIP

3.1 These TCG also present the obligations arising from the participation in the Festival and the relations established between NEVERSEA and Participants on the occasion of the Festival, the latter being obliged to comply with them, the application of the TCG reaching the guarantee of the safety and comfort of the TCG. 

3.2. The TCG should be read in conjunction with the Privacy Policy. The TCG will be posted both on the website www.neversea.com and at the entrance of the Festival. 

3.3. These TCG set out the rights and obligations arising from the receipt of an Order Confirmation, the purchase of Products and participation in the Festival and the relationships established between NEVERSEA and the Buyer and Participants.

3.4. By purchasing Products or participating in the Festival at the Festival, Product Buyers and Participants accept and agree to comply with:

● TCG and any related obligations and responsibilities. Any Product Buyer and Participant who violates the TCG may be liable for legal action, denial of entry to the Festival and/or removal from the Festival perimeter.

● security measures, notices, requests or announcements displayed or given by the Police, Security Personnel or agents representing any of the Associated Entities, including without limitation, all instructions or announcements regarding access and security to the Festival;

● all national laws and regulations.

3.5. The Buyer and the Participant agree to indemnify the Promoter for any damages, losses, liability or injury that such parties suffer or may suffer as a result of the failure of the Buyer and the Participant to comply with these T&Cs.

 

IV.    TICKETS AND BRACELETS

4.1 Visitors are admitted to the Festival on the date and time as specified by the organizer. By purchasing a valid Ticket, each Participant ensures the right to participate in the Festival, with the obligation to know their rights and obligations within it.

4.2.  Before announcing the date of the festival, the Organizer will issue vouchers that will be converted into access tickets once the date is announced. After this moment, the vouchers will become actual tickets that ensure access to the festival.

 

TYPES OF VOUCHERS AND TICKETS

4.3 Participation in the Festival is done using one of the following types of Vouchers that will turn into Tickets once the festival date is announced:

 

A) Standard Voucher (General Access) - guarantees the Authorized Participant access to the Festival for its entire duration.

B) VIP Voucher - guarantees the Authorized Participant access to the Festival for its entire duration. VIP membership holders have access to a specially designed bar area with premium drink options. Access to the Festival for VIP season ticket holders is through a special entrance.

Important! The access of persons under 18 to the VIP area is strictly prohibited. The Contractual Partners who operate the VIP platforms will be able to establish differentiated access conditions on the platform, depending on the services offered by the Partner and paid for by the consumer.

C) One-Day Voucher - Guarantees the Authorized Participant access to all stages of the Festival on that particular day, starting from the opening time communicated by the Organizer until the Festival closes for that day. The Participant will not have access to the Festival on other days.

D) UNDER 25 Voucher - Guarantees access to the Festival for the entire duration of the event for Participants who meet the "UNDER 25" program conditions. The products within the Under 25 Program are dedicated and available only to individuals who meet the following criteria:

  1. The person purchasing this pass must be under 25 years old on the first day of the Festival, the date of which will be announced by the Organizer.
  2. The person must be enrolled in a form of education in Romania and can provide proof of enrollment in an educational institution in Romania by presenting a document that certifies this fact (such as a student ID, certificate, etc.) along with their identity card to verify their name and age.
  3. At the time of the Festival, the pass holder must go to the "Accreditation" point located within the Festival grounds, where they will collect their festival wristband by presenting their identity card and proof of student status (the document should have the personal identification number (CNP) redacted in a manner that ensures it cannot be deciphered, e.g., crossed out with a marker).
  4. If the Under 25 pass holder cannot prove their eligibility, they will have to pay the difference between the full price of the pass and the price paid for the promotional pass. Otherwise, access to the Festival grounds will be denied.
  5. These passes are offered under a program and are available while supplies last. Prices are listed in the Tickets section on the website.

 

TYPES OF INVITATIONS

4.4 Participation in the Festival is also done using one of the following types of invitations (which will be assimilated to the Tickets):

A) Standard Invitations (General access) - guarantees the Authorized Participant access to the Festival for the entire period of its duration, starting from the first day from the opening time communicated by the Organizer and until the end of the Festival.

B) VIP Invitations - guarantees the Authorized Participant access to the Festival starting from the first day from the opening time communicated by the Organizer and until the end of the Festival. VIP invite holders have access to a specially designed bar area with premium drink options. Access to the Festival for VIP invitation holders is through a special entrance.

Important! The access of persons under 18 to the VIP area is strictly prohibited. The Contractual Partners who operate the VIP platforms will be able to establish differentiated access conditions on the platform, depending on the services offered by the Partner and paid for by the consumer.

C) One-day invitations - guarantees the Authorized Participant access to all the stages of the Festival on that day, starting with the opening time communicated by the Organizer and until the following day at the closing time, the time at which the Ticket expires, and the Participant no longer has access within the festival.

 

SERVICES AND ACCOMMODATION

4.5 The organizer offers through the website www.neversea.com a series of products that include services and accommodations or various packages that will be offered in collaboration with our contractual partners. Additional information regarding the detailed terms applicable to the purchase of these Services will be provided by our Contracting Partners upon purchase of the Services. The buyer of accommodation services must also comply with the rules and regulations of the location of accommodation purchased.

4.6. The purchaser of the voucher/tickets/passes has the obligation not to display images of them online. 

4.7. It is strictly forbidden to sell or buy invitations.

4.8 We encourage people who enter the Festival Area using an invitation to donate an amount of money (in the places that will be signaled in this regard), amount that will be used for charitable purposes, described in the specially arranged locations.

4.9 Tickets/Invitations provide access to the Festival for one person only.

4.10 The organizer reserves the right to modify the list of artists participating in the festival, both before and during the entire duration of the Neversea Festival event. Tickets purchased for participation in the entire day of the event, as well as subscriptions, give the buyer access to the perimeter of the festival and not to a specific show/artist.

4.11 Each location in the festival perimeter has a limited capacity and access may be temporarily restricted to comply with the safety regulations in force.

4.12 Standard tickets/subscriptions may be changed to VIP Tickets/subscriptions, upon payment of a price difference, within the limits of available stocks.

4.13 In the case of the price of a ticket expressed in EURO, the reference rate was set at the value of 5.0000 lei as of 08.08.2023, time 08:52:24, of Transilvania Bank.

4.14 The Organizer reserves the right to change the currency exchange rate and the price of the Tickets without the need for prior notice. The change in ticket price does not apply to tickets already purchased at the time of the change.

 

PROHIBITIONS

4.15 It is strictly forbidden to transmit or post the unique series of tickets and/or subscriptions on social networks or other websites of this kind (e.g. Facebook, OLX, etc.).

4.16 Failure to comply with these provisions will result in the cancellation of the invitations/tickets or subscriptions sold and the banning of access to the festival of the persons involved in this operation.

4.17 IMPORTANT! The sale or purchase of invitations is strictly prohibited and the purchase of tickets or subscriptions is not recommended except through authorized ticketing platforms (www.extasy.com or any other authorized platforms, referred to as Contractual Partners). 

THE ORGANIZER CANNOT GUARANTEE THE VALIDITY OF ANY TICKETS NOT PURCHASED THROUGH THESE CONTRACTUAL PARTNERS. IF ANY TICKET FRAUD IS DISCOVERED, THE ORGANIZER RESERVES THE RIGHT TO CANCEL THAT TICKET AT ANY TIME (even if the holder of a fraudulent ticket has successfully completed the check-in or transfer process). THE ORGANIZER DRAWS ATTENTION TO THE FACT THAT A SERIES OF FRAUDS WERE DISCOVERED THAT OCCURRED FROM THE SALE OF TICKETS THROUGH UNAUTHORIZED CHANNELS, AND IN THIS CASE THE CONSUMER ASSUMES THE RISK OF PURCHASING A TICKET WHICH WILL NOT ALLOW THEM ACCESS TO THE FESTIVAL. 

The organizer reserves the right to resort to legal means to sanction those who will be found to be carrying out such activities, as well as to cancel the respective invitations/tickets/subscriptions.

4.18 Tickets and/or subscriptions purchased may be used for commercial purposes, such as for organizing promotional campaigns, offering tickets and/or subscriptions as prizes for contests, etc., only with the prior written consent of the Organizer. Failure to comply with this obligation will lead to the cancellation of tickets and/or subscriptions used for commercial purposes and obliging the persons responsible to repair the damage thus created. At the same time, the organization of promotional campaigns through the use of tickets and/or subscriptions to the Festival, without the prior written consent of the Organizer, constitutes a violation of intellectual property rights regarding the NEVERSEA Brand.

 

CONTRACTUAL PARTNERS

4.19 Tickets may be sold directly to Participants by Neversea or its Contractual Partners and their payment processed by Neversea's or Contractual Partners' payment processor. The ticket authorizing participation in the relevant Festival is sold to the Buyer by the Extasy platform or other Contractual Partners (as this right is assigned by Neversea). All payments are made through Contractual Partners. The Organizer only guarantees the validity of Tickets sold through the networks of these Contractual Partners.

4.20 Additional information regarding the detailed conditions applicable to the purchase of Tickets online or in physical format will be provided by our Contractual Partners at the time of purchase.

4.21 Our Contractual Partners sell Tickets at fixed locations and online ticketing interfaces.

4.22 The Buyer/Consumer will receive information from the Contractual Partners in particular in relation to the following aspects: taxes and commissions applied to the price set by Neversea, payment and payment methods, invoicing, data processing of the Buyer/Consumer and reimbursement possibilities, to the extent in which they exist.

4.23 The tickets accepted by the Organizer can be in physical format or in electronic format (eTickets) which are sent to you in the form of a QR code in My Wallet in the personal account, in an e-mail or printed on paper, which each Participant has the obligation to bring it with him to the event or to present it in the original in electronic format (on a phone, tablet or other electronic devices that allow this). Careful! Pictures taken with the tickets are not accepted! Most of the customers of Contractual Partners receive tickets within 3-5 minutes after the payment is successfully completed. If your ticket has not arrived by e-mail after 24 hours from placing the order, you must contact the platform from which you purchased the ticket within 10 days of purchasing the ticket, but no later than one day before the start of the Festival. NEVERSEA is not responsible in any way for this kind of situations, and in the absence of a valid ticket, access to the Festival will not be allowed.

OTHER TICKET-RELATED FEES AND SERVICES

4.24.1 The final price paid by the Buyer will consist of the base price of the ticket plus, it will also include administration and processing fees, 1% Red Cross stamp duty, taxes related to collective management bodies.

4.24.2 Neversea is not responsible for administration and processing fees which may differ depending on the platform from which the ticket is purchased and the Contractual Partners from which the consumer/buyer purchases the good. NEVERSEA is not responsible for the extra services offered by the Contractual Partners.

 

RISK FREE 

4.25.1 The additional Risk Free service offered by NEVERSEA, which undertakes to return the value of the access ticket to the buyer, if the Buyer cumulatively meets the following conditions: 

i) requesting its reimbursement within the term stipulated in art. 4.25.2, 

ii) in case of non-appearance at the event and 

iii) to the extent that the buyer opted for this service and paid the related fees, as follows:

4.25.2 The buyer can request the return of the purchased Risk Free ticket at any time, but no later than 14 days before the start of the event.

4.25.3 NEVERSEA undertakes to EXCLUSIVELY return the value of the ticket, without the Risk Free fee (set by the organizer in the range of 10-25 Euro) within a maximum of 30 days from the moment of the request, if the Buyer has not changed his mind and has not used that ticket for access to the festival and if the request was made within the deadline.

4.26 Except for the situations provided for in art. 4.25, the money on Tickets purchased for this event is not returned, the purchase of tickets to shows and entertainment activities being exempt from the application of the right of withdrawal regulated by GEO 34/2014.

4.27 The Organizer assumes no responsibility for the loss or theft of the Ticket and/or subscription. The organizer has no obligation to refund the amount of money or to replace the Ticket and/or subscription in case of loss or theft of the Ticket and/or subscription.

4.28 The Buyer expressly gives his consent for the Organizer to request and process the Buyer's home or residence address in order to send the festival access bracelet directly to the indicated address, in order to ensure in a more pleasant and more efficient access to the Festival. The Organizer reserves the right to offer this option to Buyers for a fee, as an alternative to the option of picking up the wristband at the location announced by the Organizer on the eve of or during the Festival. If this service will be available, the Organizer will complete this section.

 

4.29. REFERRAL CAMPAIGN

4.29.1. Any person who has an account on the platform www.neversea.com can benefit from the campaign as follows: 

  1. In their personal account on the platform, the user will have access to a section called "Referral," where they can view the benefits and mechanics of using the unique code automatically assigned to them. 
  2. The unique code can be used exclusively for purchasing subscriptions or products available through the Referral link. The unique benefit code is automatically applied to the person who receives the link and purchases a product. 
  3. The link with the unique code can be used for a maximum of 10 orders (each order can include multiple products). Regardless of the number of vouchers/subscriptions purchased through the order, the Participant will receive the equivalent value in the form of top-up for a maximum of 10 products (vouchers/subscriptions) purchased. 
  4. For each voucher/subscription product purchased, the Participant will receive a value voucher of €10 for each subscription. These cashback amounts can be used exclusively for loading onto the bracelet or the Festival ticket for top-up, which can be used to purchase products at the Neversea 2025 Festival by paying with the bracelet.

4.29.2. The amounts will be visible as a Reward in the Wallet only after the product purchase has been completed and the payment has been received by the Organizer.

4.29.3. The maximum amount a Participant can earn through these referrals is €100 in the form of top-up.

4.29.4. The cashback Reward is only available if the Participant has a valid ticket to the festival and attends it.

4.29.5. The Participant is required to use the entire amount within the NEVERSEA 2025 Festival, as the amounts cannot be carried over to future Festival editions, cannot be withdrawn at the end of the event (either fully or partially), and cannot be transferred back to the Wallet. Thus, any amounts obtained by the Participant through the campaign that remain unspent will not be refunded at the end of the Event either online or on-site. If, for any reason, the NEVERSEA Festival does not take place in 2025, the Participant will not be entitled to the payment of the equivalent amount in lei of the sums earned or any other kind of compensation.

4.29.6. The value of the voucher obtained in this Campaign cannot be converted into cash, nor can these prizes be exchanged.

4.29.7. From the moment the value voucher in the form of cashback is made available in the user's Wallet, the Organizer is released from any obligations towards the user.

 

5. CHECK-IN OBLIGATION

5.1 In order to be allowed access to the Festival Area, the holder of a valid Access Ticket must check in the purchased Ticket. The buyer of a ticket has the possibility to check-in in two ways: online or on-site (at the location).

5.2 Check-in can be done for a fee on-site (at the entrance to the Festival Perimeter) or free of charge under certain conditions stipulated in these TCG and exclusively online (on the website www.neversea.com or through the Neversea application ).

 

5.3 On-site check-in (at the location of the event)

5.3.1 On-site check-in will be performed by the organizer's Contractual Partners, who use their own infrastructure and staff. Attention: On-site check-in will be possible every day of the festival in the time interval communicated by the Organizer.

5.3.2 On-site check-in will be done in all situations for a fee that is paid at the ticketing points where the wristband will be issued based on the ticket. The fee for the check-in service at the location is in the amount of 25 EUR, and it is paid when the buyer presents himself with the original identity document.

5.3.3 Attention!!! The scanning of the identity document (identity card/passport) is done only partially, only data consisting of: name, first name, gender, country/location of origin, date of birth, nationality, and the photo on the identity document are collected, without retention the following data, such as: the personal numerical code, the series and number of the bulletin, the picture of minors, or any other sensitive data. For more details on the personal data processed by Neversea please read our Privacy Policy.

5.3.4 If the Ticket holder does not want his identity document to be scanned, an operator will record the data provided by the person in question based on the original identity document presented on the spot.

5.3.5 Each valid Ticket holder, who checked in and presented himself at the entrance to the Festival Area, receives a Wristband (the color of which depends on the type of Ticket purchased) to which is attached the data collected in the process of check-in. After performing the process of exchanging the Ticket with a Wristband, the Wristband will confer the rights and obligations stipulated by the Ticket.

5.3.6 Neversea will register the Visitor's Wristband during the entry procedure, provided that the Visitor has validly checked in the Ticket.

5.3.7 Wristbands are non-transferable.

5.3.8 Visitors are obliged to wear the Bracelets, during their validity, on their wrist or, in exceptional and well-justified cases, in another visible place, provided that the Bracelet cannot be removed without being damaged. The Festival organizers can inspect the Wristbands at the entrance, at the exit and on the entire perimeter of the Festival, during the entire duration of the Festival.

5.3.9 The Visitor is fully responsible for any damage or loss of the Bracelet.

5.3.10 Damaged wristbands, which have been resealed or cut, whose closure system has been opened, those with a larger diameter than the wearer's wrist or which have been tampered with in any way, are NOT valid, and the organizers reserve the right to to retain such bracelets, to deny access to people in the festival and to report the situation to the competent authorities.

5.3.11 Neversea will not replace damaged or lost wristbands unless the Participant can prove the purchase of the ticket associated with that wristband in a legal manner. Participants who cannot provide this proof lose the right to be in the Festival Area, being excluded from it.

5.3.12 In case of loss or damage of any kind to the Wristband, the Participant is obliged to purchase a new Ticket for the day in question if he wishes to remain within the perimeter of the Festival.

5.3.13 If the bracelet appears to have been damaged fraudulently, the Organizer has the right, in addition to the rights provided in art. 5.3.9, to compel the Participant to purchase a One-Day Ticket regardless of whether the Participant can prove the purchase of a ticket legally and regardless of whether or not they wish to remain in the Festival Area. This right can be exercised at your discretion, and depending on the availability of tickets for that day.

5.3.14 If, upon access to the Festival Area, the Ticket holder is suspected of illegally acquiring the Ticket, Neversea expressly reserves the right to request the Ticket holder to present evidence (documents and/or certificates) to verify the acquisition or legal purchase of the Ticket, as well as the right to evaluate whether they are valid and compliant, and in the absence of a document to reimburse the purchase price and to refuse the entry of the respective person to the Festival Area.

5.4 Check-in Online

5.4.1 The Online Check-in process involves the registration/assignment of a valid ticket in an account created by the Visitor, through the NEVERSEA website or application, and providing the personal data requested for this step. The online check-in process is free only during the first 30 days of purchasing the ticket, after which a fee of 15 EURO is charged. NEVERSEA encourages all Buyers to check-in online at the time of ticket purchase to avoid paying additional fees and ensure smooth access to the festival. Payment of the online check-in fee will be made through secure payment platforms.

5.4.2 The 30 free days for online check-in are calculated starting from the day the subscription was purchased.

For example: if the customer purchased a subscription on 31.10, he has the opportunity to check in online for free until 29.11 (inclusive).

Online Check-In for tickets purchased offline - Partners

5.4.3 The process to claim the ticket purchased offline is done by entering the personal profile and entering the electronic code in the Redeem section. After activating the code, the holder will receive the ticket in the My Wallet section and by email. 

5.4.4. Check-in is free for the first 30 days after purchasing the ticket. After this term, the user must pay the 15 Euro fee for each Check-In performed. The platform will automatically indicate how many days are left of the free period and the amount of the Check-In fee.

5.4.5 If, after claiming the ticket, the holder is no longer able to arrive at the festival, he has the option to transfer the ticket to another person, applying the provisions relating to Transfer and Online Check-In in this document.

Online Check-in for tickets purchased online

5.4.6 To carry out the online check-in, the holder of a ticket must log in to the account from which he made the purchase and access the My Wallet section where the purchased tickets will be displayed. The holder will have to select the ticket for which he is going to perform the Online Check-in and follow the indicated steps.

5.4.7 The user can check-in for free in the first 30 days after purchasing the ticket.

5.4.8 In the situation where the User is no longer in the free period (the first 30 days after purchasing the ticket), in order to perform the Check-in, he will have to pay the equivalent of 15 Euros. If a user has purchased several tickets, he will have to pay the fee of 15 Euros, for each individual ticket. 

5.4.9 After selecting the ticket, the user must upload a picture (bulletin type) and fill in the following data: name, surname, phone number, email, gender, date of birth, country, city, county. In the case of minors, since their picture has not been processed, the Organizer will automatically set a general and impersonal image.

5.4.10 Users under the age of 18 are required to download and complete the Parental Consent form. 

5.4.11 At the time of Online Check-in, the Visitor is solely responsible for the correctness of the data entered. The organizer has the right to check on the spot whether the data entered by the visitor correspond to the data on his identity card. 

5.4.12 At the latest at the time of the Online Check-in, the User acknowledges and agrees with the Terms and Conditions of the Festival, displayed on the website www.neversea.com. 

5.4.13 If the user has purchased several tickets and wants to check in for the other tickets as well, he can do so by entering the data of the people who will use the tickets for each ticket separately. The holder of the group of tickets is directly and solely responsible for the correctness of the data entered and will obtain consent from each person for whom they check in that they have read, understood and agree to the Neversea Terms and Conditions and regarding the Privacy Policy.

 

6. TICKET TRANSFER POLICY 

6.1. The transfer of a ticket implies the transmission of the product by its current owner to another person who will take over the rights and obligations arising from its use.

6.2. Once the holder chooses to transfer the ticket to another person, he accepts and undertakes to waive all rights he had in the ticket. 

6.3. Check-in is free for the first 30 days after purchasing the ticket. After this term, the user must pay the 15 Euro fee for each Check-in performed.

6.4. The transfer of the ticket is carried out for a fee. Transfer costs are as follows:

● Standard General Access - 75 lei

● General Access 1-day ticket - 35 lei

● VIP - 150 lei

● VIP One-day ticket - 75 lei

● Standard General Access invitation - 150 lei 

● Invitation Standard General Access 1-day ticket - 70 lei

● VIP invitation - 250 lei

● VIP invitation One-day ticket - 150 lei

6.5. The transfer is possible for tickets with or without Online Check-In.

 

A. Transfer for tickets without Online Check-In:

To make the transfer, the ticket holder must log in to his account and select the Transfer button, subsequently being automatically directed to the form for filling in the information of the person to whom the transfer is made.

B. Transfer for tickets with online Check-In:

To make the transfer, the ticket holder must log in to their account and delete the Check-In free of charge. After deletion, the owner will select the Transfer button and is directed to the form to fill in the information of the person to whom the transfer is made. 

 

6.6. In both situations, after the transfer by the old owner, the new owner will have to follow all the steps to complete the online check-in for the transferred ticket, free of charge or at a cost, based on the number of days from the time of purchase of the ticket. If the period of 30 days from the purchase has been exceeded, the new owner who receives the ticket will pay the 15 Euro fee.

6.7. If the ticket holder has deleted the Check-In but no longer wishes to transfer the ticket, the provisions related to making a new Check-In remain valid.

6.8. To carry out the Ticket Transfer, the holder will have to fill in the data of the person who will receive the ticket (name, surname, telephone). 

6.9 A ticket that has both Online Check In and Online Top Up cannot be edited or transferred! 

6.10. The only ticket transfer mechanism from one holder to another authorized and recognized by the Organizer is this, through the official platform. Pictures on QR codes are not accepted!

611. Access to the event will be based on an identity document (identity card or passport) and the ticket with a valid QR/code.

7. RHUNA AND USE OF ACCOUNT BALANCE 

7.1. General aspects

7.1.1. Rhuna, as defined in these Terms and Conditions, is used for the purchase of Rhuna products and services within the Neversea festival and on the www.neversea.com platform. 

7.1.2. Through the personal account on the Neversea platform (website or application), the user will be able to load an amount of money into the system by pressing the "Top Up Account" button, which, with his consent, will be transformed into RHUNA and will be visible in the Balance section Account.

 

7.2. Use of Rhuna

7.2.1. Once the amount of money has been deposited into Account Balance and converted into RHUNA, the user will be able to use this tool to: 

a) Purchase of Rhuna products and services.

b) Charging the ticket and the access bracelet for the purchase of products and services within the festival.

 

7.3. Validity and withdrawal of Rhuna

7.3.1. RHUNA loaded into Account Balance has a validity period until December 31 of each year related to the festival edition. After this term, the existing amounts in the Account Balance will expire.

Example: Money converted to RHUNA for Neversea Festival 2024 remains valid for the purchase of products and services until December 31, 2024. Money added to the personal account in 2025 will be valid for the purchase of products or services until December 31 2025.

7.3.2. After the conversion of amounts of money into Rhuna, the user can no longer convert Rhuna into its equivalent in money and/or withdraw the converted amount, except in exceptional circumstances (death, inability to use the account for a long period of time, demonstrated by supporting documents).

 

7.4. Rewards system

7.4.1. The organizer can grant certain benefits in the form of advantages and rewards that can be used to purchase Rhuna products and services during the festival, on the Neversea platform or to top-up online on the ticket.

7.4.2. These benefits, called Rewards, have the following characteristics:

● They cannot be withdrawn. Rewards cannot be converted to cash and withdrawn from the account.

● They cannot be converted into their cash equivalent.

● Expires upon completion of the festival edition for which they were awarded. Example: If the user received a reward on the Neversea Festival in March 2025, it will be able to be used until the last day of the Neversea Festival 2025.

● The monetary equivalent of the Reward will be withdrawn with priority in case of purchase of Rhuna products and services or top-up. Example: If the user received a reward for the 2025 edition of the Neversea Festival and additionally loaded an amount of money into the Account Balance, when purchasing a product, the value of the Reward will be used first, then the amount of money loaded.

 

7.5. Payment processing

7.5.1 The Neversea platform uses the services of Banca Transilvania for loading sums of money into the Balance Account which are converted into Rhuna.

7.5.2 Online payment with your personal or company card can be made in complete safety. Cards accepted for payment are those issued under the logos VISA (Classic and Electron) and MASTERCARD (including Maestro, if they have a CVV2/CVC2 code).

7.5.3 Payment is based on a secure online transaction processing system that provides privacy, security and simplicity in purchasing products and services over the Internet. Card data is processed exclusively through the bank.

7.5.4 The Organizer is not responsible for any technical or system errors that could affect the operation of the Account.

7.5.5 The user is responsible for the security of the access data to the personal account and for all activities carried out in his account. The organizer is not responsible for the unauthorized use of the user's personal account.

 

8. TOP UP ONLINE

8.1 Top Up Online is a service offered by the Festival to users, which allows them to top up their festival ticket with money by online payment or by transfer from My Balance, and the said amount will be transferred to the festival wristband. This service is only available to users who have completed a valid online Check-in.

8.2 Top Up Online can only be done from cards that have 3D Secure activated.

8.3. Top Up Online pre-festival – for users who have done Online Check-In

a) After online Check-in, the ticket becomes available in the Account Balance area and you will be able to Top Up by activating the "Top Up Details" button.

b) The user can select different top up options:

○ Single Transfer from the user's account: The selected amount that he wants to load on the bracelet is transferred only once.

○ Auto top up when the balance drops below a certain value: By activating the option, when the credit drops below a certain amount set by the user, the account ticket is automatically loaded with the set amount, taking money from the Account Balance or from the card, if the Account does not has enough funds.

c) The user will be transferred to a secure payment page, where they will have to enter their card details and 3D Secure verification code.

d) After successful payment, the user will be able to view the total amount deposited on the ticket.

e) After completing the online Top-up, the amount of money on the bracelet must be activated at any of the merchants inside the Festival or at Credit Points.

f) After activating the top up, the User can spend the money in the Festival, at any time, during the entire period of the festival.

g) If the user has spent all his money, he can repeat the same steps described above to recharge his bracelet or he can go to any charging point - Credit Point inside the festival.

 

9. METHOD OF PAYMENT WITHIN THE FESTIVAL 

9.1 The method of payment for the Products and Services offered in the Festival Area is through multi-use vouchers used using payment devices (RFID), made available by Neversea, through the Festipay service, respectively activating them on the wristband.

9.2. Participants are obliged to use only the payment methods and instruments established by the Organizer in the Festival Area.

9.3 Upon entering the Festival Area, each Participant will receive a Bracelet (with the integrated payment system) with which they can purchase the Products and Services available within the Festival. Cash payment in the Festival Area is strictly prohibited, outside of the Credit Point areas established in advance by the Organizer.

9.4 These payment instruments are considered MPV (multi-purpose vouchers = vouchers with multiple use), as defined by the European Commission, due to the fact that in exchange for the Credit Points on the payment instrument, the Participant can purchase services/products that have different VAT rate. In this case, VAT is collected when using credit points. At the same time, issuing a tax receipt and/or an invoice for the purchased Product/Service is the responsibility of the traders (Contractual Partners). If a Participant wants a tax invoice for the Products/Services purchased during the Festival, he has the obligation to keep all the tax receipts from each merchant (Contractual Partner) separately in order to request the tax invoice from the respective Contractual Partners.

9.5 The Organizer has the possibility to provide Visitors with proof that the transaction (deposit or withdrawal of funds) has been carried out.

9.6 The procedure for transactions in the electronic system during the Festival is as follows:

a) Upon entering the Festival Area, after obtaining the Wristband, it is recommended that each Participant go to one of the "Credit Points" to load their Wristband with credit points.

b) The bracelet will be the only method of payment during the Festival.

c) The conversion for this MPV (multi-purpose voucher) is: 1 leu – 1 credit point.

d) For each charge, the Organizer has the possibility, but not the obligation, to hand the Participant a proof for the amount deposited on the Wristband.

e) Damaged Wristbands can be deactivated and replaced with other Wristbands at the Help Desk - Credit Point, located in the Festival Area, throughout the duration of the Festival, taking into account the provisions of point 5.3.11.  

f) After obtaining a new Bracelet from the Help Desk - Credit Point, the amount held by the Participant on the damaged Bracelet will be transferred to the new Bracelet.

g) Participants can load their Bracelet as many times as they want, but each load must have a minimum amount of 1 leu.

h) The Participant has the right and possibility to check the amount available on the Wristband at any Contractual Partner in the Festival Area or at the Credit Point.

i) Charging/Recharging the Bracelet can be done either by cash, via the bank card or via the www.neversea.com platform (for bank cards issued under the Visa, Visa Electron, Mastercard, Maestro logo issued by any bank in the world), according to the Chapter "Top Up Online" of this Regulation.

j) In case of loading/reloading the Bracelet through the Website, the Participant assumes full responsibility for the card data entered in the platform.

k) The 3D Secure security code will be requested for the first payment made with the bank card. If the first payment is authorized, subsequent payments can be made without the 3D Secure security code. 

9.7 No commission is charged for bank card payments!

9.8 Purchase of Products/Services from merchants (Contractual Partners):

a) The Participant chooses the desired Product, at which point the respective Contractual Partner checks the amount in the POS;

b) Each Participant has the obligation to check the amount checked by the Contractual Partner in the POS, and after checking, he will touch the chip on the Bracelet with the POS - contactless terminal (card-reader) to make the payment;

c) The Contractual Partners will have the obligation to issue tax receipts to the Client Participants (and invoices, at the request of the Participants).

 

10. REFUND – Return of the money left on the Bracelet at the end of the Festival

10.1 The REFUND represents the action by which a festival-goer recovers the money left on the bracelet, under the conditions detailed in these Regulations.

10.2 The unused amounts on the RFID bracelet can be exchanged for money, through the process called REFUND, if all the conditions imposed by the Festival are met.

10.3. In the event that the festival-goer has not withdrawn the unspent amounts from the bracelet or has not carried out an action by which he requests the redirection to the Balance Account, the return to the card or the donation of the amount by the announced date, these amounts become the property of the Festival.

 

10.4 The refund can be made in the following ways:

 

10.4.1 REFUND ON LOCATION

10.4.1.1 Returning the amounts to any of the charging points on the festival perimeter, at any time during the festival, but no later than the date that will be announced later by the Organizer.

Any request received after the announced date will not be considered by the organizer. In this situation, the organizer cannot be held responsible for the non-reimbursement of the amount, as it is the exclusive duty of the festival-goer to respect the established deadline. WE RECOMMEND FESTIVAL GOERS TO MAKE THE REFUND REQUEST NO LATER THAN THE TIME THEY LEAVE THE FESTIVAL IN THEIR LAST DAY OF PARTICIPATION.

10.4.1.2 The returned amount represents the entire amount remaining in the RFID Bracelet account (including those resulting from online transactions).

10.4.1.3 To make the Refund, the festival-goer must wear the bracelet on his hand and ensure that it shows no signs of compromise (except for the cases agreed by the Festival and presented in these Regulations).

10.4.1.4 If the customer made the Top Up using a bank card, the maximum amount he can withdraw in cash cannot exceed 2000 LEI.

10.4.1.5. For situations in which the balance of the bracelet is greater than 2000 LEI, the customer will have to present to the HelpDesk the receipt issued by the bank POS, with proof of deposit of the amount. The customer will complete a refund request for this amount, which will be sent to the banking partner. Refund processing can take up to 14 working days. The amounts requested by completing the form will be returned to the account from which the initial payment was made.

10.4.1.6. Holders of hard-card tickets can present themselves for a refund exclusively at the points at the location. 

 

10.4.2. REFUND ONLINE

10.4.2.1. The Online refund process is carried out through the user's account, in the Account Balance section. The festival-goer will press the "Refund" button and will have the option in the platform to select one of the following actions regarding the amounts on the ticket:

1. Forwarding back to Account Balance. Amounts in the Balance Account can be used to load the ticket to a new event or to purchase products and services.

2. Donating the amount to a cause supported by the Organizer.

3. Returning the amount to the card with which the charge was made.

10.4.2.2. The online refund process refers to the return of amounts from online transactions ONLY. The return will be made by expressing an option until the date announced by the Organizer, as indicated in the platform. Any request received after this date will not be considered.

10.4.2.3. In this situation, the organizer cannot be held responsible for the non-refund of the amount, being the exclusive duty of the festival-goer to formulate the request for restitution within the given period.

10.4.2.4. For the online return of unused amounts, a commission of 5 RON is charged - processing fee, automatically withdrawn from the festival account. There are no fees for transferring funds back to your Account Balance. 

10.4.2.5. If a user made a pre-festival Top Up and wants a refund before the start of the Festival, he will be able to do so only in exceptional situations, analyzed punctually by the Organizer.

10.4.2.6. The festival-goer is permanently shown, within the account created by him, the total amount of money he has left on the bracelet and which he can request via REFUND online.

 

10.5. REFUND order for the situation in which the top up was done with several bank cards.

Each transaction is associated with a bank card. If two top-up transactions are made on two different cards, the money will be debited first from the top-up card. For example, if you first charge 100 Ron from one card and then 100 Ron from a different card, and 80 Ron is spent during the festival, the remaining amount in the bracelet account will be 120 RON. At REFUND, 20 RON will be returned for the first transaction (the first card from which the online top-up was made) and 100 RON on the second card, respectively for the second online transaction.

 

10.6. REFUND in the situation where the festival-goer has done both online top-up and top-up at the location:

If there is unspent money on the bracelet, the festival-goer will be able to get a refund online only in the amount of the transaction he made online. For example, if a 50 RON top-up is done online, and a 150 RON top-up is done at the location, the balance of the bracelet will be 200 RON. If 70 RON is spent during the festival, a total of 130 RON will remain on the bracelet. From this amount, the festival-goer will be able to get only 50 RON REFUND online, and the rest of the money will be withdrawn at one of the loading points in the Festival, but no later than the date announced by the Organizer.

 

11. GENERAL FESTIVAL ACCESS RULES

11.1 Entry to the Festival is possible only through the designated places and times, exclusively for Authorized Participants.

11.2 Access to the Festival Area is made only at the specially arranged entrances, in compliance with the procedures for registering the purchased Tickets, the check-in and access rules, provided by these TCG.

11.3 In order to reduce the congestion created in the access area, as well as the discomfort of the participants, two entries per day will be allowed into the festival.

11.4 Access to the Festival Area will be based on the type of ticket purchased.

11.5 Participants have the obligation to carry identity documents in addition to the Ticket.

11.6 At the request of the security team or the Organizer's representatives or other competent bodies or authorities, the Participant has the obligation to present the access documents and identity documents.

11.7 These TCG will be displayed in a visible place at the entrance to the festival and in other public areas within the festival.

11.8 To ensure the safe conduct of the Festival, NEVERSEA reserves the right to restrict the type of objects that can be brought into the Festival area.

 

This list is not exhaustive, the organizer having the right to deny access to the festival to the extent that the object owned by the participant could endanger the safety of other participants or present a danger to the safe conduct of the event. 

 

Therefore, it is forbidden to enter the Festival with the following items: 

● Drugs or any kind of psychoactive substances;

● Accessories for 

● Bottles (including but not limited to PERFUMES, sprays or deodorants);

● Flammable cosmetic products (beach cream is allowed);

● Backpacks or purses larger than 29 cm x 21 cm x 12 cm;

● Beverage cans;

● Preserves;

● Fireworks; 

● Lasers;

● Sprays or corrosive/flammable substances, paints or containers with harmful or flammable substances;

● Banners supported by sticks;

● Chairs;

● Weapons or any objects that can be adapted as weapons or projectiles;

● Knives, blunt objects or any sharp-pointed or sharp-edged objects;

● Chains or objects that have chains attached (such as wallet, pants, etc.);

● Torches, smoke detectors or any other pyrotechnic articles;

● Food or drinks;

● Animals;

● Umbrellas of any kind or shape (in case of rain, capes will be used);

● Flammable or explosive materials;

● Professional cameras or video cameras, including any type of DSLR or camera with detachable lenses;

● Any type of objects that may injure other Participants.

● Drones;

● Speakers, amplifiers or audio systems;

● Devices that produce sound, operated electronically, mechanically or manually, such as megaphones or vuvuzelas, musical instruments;

● Selfie stick or tripod;

● Lasers!

● Any substance that is flammable; 

● Any offensive, racist, xenophobic, sexual, religious, political or other illegal/prohibited material, discriminatory propaganda messages;

Access is allowed with: 

● Compact cameras;

● Lighters;

● GoPro cameras;

● Selfie sticks (small and made of light materials);

● External, portable batteries;

● Lipsticks or lip balm;

● Beach cream;

● Non-flammable perfume or deodorant in containers smaller than 50ml. 

● Baby bottles.

 

Access with: prescription drugs, insulin, drops - medical use, inhaler spray for asthma is allowed only if they are accompanied by a medical letter or any other document replacing it and in the maximum recommended daily amount.

 

11.9 Due to the very strict rules regarding prohibited items, the people responsible for the security and monitoring of the Festival will thoroughly search each Participant and any prohibited items discovered during the check will be stopped at the gate, without the Organizer taking responsibility for them.

11.10 All Participants are advised to consult the list of prohibited items and not to have such items on them during the Festival.

11.11 Regarding lost objects, the Organizer will set up a special space where such objects can be brought and from which each owner can recover their goods within 72 hours, but no later than the first day after the end of the Festival - at time announced by the Organizer.

11.12 The organizer has the possibility, but not the obligation, to photograph the lost objects and display them on social networks, as the case may be, to the extent that this action would not violate the legal norms regarding the protection of personal data.

11.13 After the first day after the end of the Festival, at the time announced by the Organizer, all unclaimed objects will be handed over to their issuers (example: identity card, birth certificate, etc., to the attention of the Municipal Police; bank cards to the attention of the issuing banks). Items without an identifiable issuer, regardless of value, will be donated to charity, to the extent possible and depending on the nature of the items.

11.14 The Organizer is not responsible for the Participant's property or for any damage caused to them.

11.15 It is forbidden to enter the Festival Area with cars, rollerblades, skates, bicycles, hoverboards, as well as with other similar goods.

11.16 For the convenience of the participants, the organizer reserves the right to temporarily stop access to certain areas, if it considers that the areas have reached their maximum authorized capacity.

 

12. MINORS AND PEOPLE WITH DISABILITIES

12.1 Minors are prohibited from consuming alcoholic beverages, cigarettes and drugs.

12.2 Minors will receive wristbands of a different color, which will allow them to be identified more easily.

12.3 Minors under the age of 7 have free access to the Festival, accompanied by a parent. At the request of the persons responsible for security and monitoring, as well as the Organizer's representatives, the companion has the obligation to present documents such as: student card, passport or any other document that contains the minor's photo, certifying his age.

12.4. Careful! The access of minors under the age of 7 is allowed only in the company of a parent and is recommended to be done by 19:00.

12.5 The access of minors between 7-14 years will be made only on the basis of a valid Ticket and no longer in the company of a parent.

12.6 A parent may accompany only one minor under the age of 14.

12.7 The access of minors between 14-18 years of age will be made only on the basis of a valid Ticket, identity document and declaration of commitment.

12.8 An adult is required to take responsibility for a minor and is required to complete and sign the "Declaration of Undertaking" available at neversea.com/parentalagreement, without which the minor will not be allowed to enter the Festival Area, whether or not they have or not companion.

12.9 The responsible person will provide in the statement of commitment contact details where he can be contacted in cases of emergency.

12.10 The organizer does not assume any responsibility regarding the verification of signatures, respectively the manner of signing the declarations, these aspects remain the responsibility/responsibility of the persons presenting the declarations.

12.11 In some areas of the Festival, the access of minors under the age of 18 is strictly prohibited (for example: the VIP area).

12.12 Due to the very loud noise produced during the Festival, the Organizer does not recommend the presence of children under 7 years of age during the Festival.

12.13 Minors under 4 must wear earmuffs.

12.14 Exceptional situations when discounts/freebies are granted to a certain category of minors or other Participants, will be reported on the website (e.g. e-Tickets), and are sent to you as an attached PDF in an email that each Participant is obliged to print it and bring it with him to the event, or present the ticket in electronic format (on a phone, tablet or other electronic devices that allow this) when checking in at the venue. 

12.15 Most Contractual Partners' customers receive their PDF tickets or a QR code within approximately 3-5 minutes after payment is successfully completed. If your ticket has not arrived by email after 24 hours from placing the order, you must contact the platform from which you purchased the ticket and resolve this issue within a maximum of 5 days from purchasing the ticket, but at the latest one day before from the beginning of the Festival. NEVERSEA is not responsible in any way for this kind of situations, and in the absence of a ticket, access to the Festival will not be allowed.

12.16 In the case of disabled persons classified in a disability category, they and their companions (if the necessity of the companion was established by an evaluation commission and can be proven by a document issued by a competent authority or was entered in the certificate of registration in the degree of disability), benefits from the following facilities within the limit of 150 subscriptions for the festival days:

a) Children with disabilities and their established companions benefit from a subscription free of charge;

b) Adults with severe disabilities and their established companions benefit from a subscription free of charge;

c) Adults with severe disabilities benefit from a subscription free of charge;

12.17 In order to benefit from gratuity, adults with disabilities (or in the case of minors their legal representatives) must send an application expressing their desire to participate in the festival and a self-responsibility declaration from which it can be seen that they are classified as handicap at [email protected]. In case of requesting the subscription for the companion, the Organizer may request additional documents certifying that the companion has been established according to the law. If disabled people will benefit from a subscription ticket, they will receive an e-mail to this effect from the Organizer. These persons are subsequently required to present the original, at the access point mentioned in the confirmation email received, the disability classification certificate and the identity card for verification.

12.18. The free access of people with special needs is done only on the basis of the identity card, the certificate of inclusion in the degree of disability and the confirmation received by e-mail from the Organizer.

12.19 Incomplete applications and/or applications sent to other email addresses will not be considered.

12.20 The Organizer reserves the right to deny access to the festival to persons with disabilities who do not present these original documents, as well as in the event that the Organizer's representatives have justified doubts regarding the validity or authenticity of the documents presented.

12.21!!! The registration period to be able to benefit from the gratuity for the 2025 edition, provided for in art. 9.11 is 01.10.2024 – 31.01.2025 by sending an email to [email protected]. All applications sent outside this period will not be considered.

12.22 Bearing in mind that this facility can only be granted within a limited number of places, taking into account the total capacity of the Festival as well as safety and security regulations, the gratuity will be granted according to the order in which requests are received.

12.23 At the time and to the extent that the number of 150 requests that meet the conditions specified above is reached, the Organizer will display in these TCG that the maximum number of tickets granted free of charge for persons with disabilities has been reached, and from that moment The organizer will no longer respond to requests in this regard.

12.24 The organizer will respond to these requests within 30 days from the date of the requests.

12.25 Persons classified as seriously handicapped undertake the obligation to always come accompanied to the Festival, for reasons of personal safety.

12.26 The organizer recommends that all minors and people with disabilities come accompanied to the Festival.

12.27 The organizer will not be held responsible for any incident or accident involving minors or persons with disabilities. All responsibility for them rests with minors/persons with disabilities and/or parents/legal representative or companion. The organizer draws the attention of parents/legal representatives or persons exercising parental authority to the fact that they have the obligation to supervise the minor and will be held responsible for any damage resulting from failure to comply with this obligation.

12.28 To the attention of people with locomotion problems, who use a wheelchair for travel: only in certain areas of the Festival are entrances with wheelchair facilities provided, these being marked on the Festival map.

 

13. BEHAVIOR DURING THE FESTIVAL

13.1 In the Festival Areas, visitors are obliged to refrain from all actions, statements or behavior likely to endanger the life, health or physical integrity of other persons or which may violate their personal rights.

13.2 Any form of economic, commercial or advertising activity is prohibited in the Festival Area - including the area in front of the Festival gates - without Neversea's prior written permission. If the Organizers find such activities taking place within the festival perimeter, they reserve the right to expel the persons in question and deny them access to the festival.

13.3 The sale of alcoholic beverages must comply with the provisions of the law, and no such beverages may be offered to minors under the age of 18 and to intoxicated persons by any vendor within the Festival. The serving of drinks (soft or alcoholic) by the organizer's Commercial Partners will be done exclusively in open (aluminum or plastic) containers.

13.4 The use of substances qualified as drugs is prohibited in the Festival Area and is punishable by law. The Organizer reserves the right to cut off the wristband of the Participant who violates this provision, to remove him from the Festival premises and to no longer allow him access, requesting the intervention of the competent bodies in this regard. 

13.5 Neversea reserves the right to introduce a system at the Festival by which alcohol can be offered to Visitors only if the respective Visitor presents a certification or a document from which it can be seen that he has the right to consume alcohol (e.g. the identity card attesting the age ).

13.6 Any demonstrations of any nature unrelated to the Festival organized by Neversea, regardless of the number of participants, are prohibited unless Neversea has given its prior written approval. This approval is granted by Neversea at its own discretion, based on the prior request of the organizer of the respective demonstration. If an approval is obtained, participants are required to comply with these TCG and to behave in a manner that does not disturb, impede, limit or make impossible the entertainment of other Visitors, the ability to moves into the Festival area, access to the Festival area or the ability to leave the Festival area, as well as the use of Services and/or Products by other Visitors/Merchants.

13.7 Neversea has the right to terminate demonstrations (both those which it has authorized in accordance with the above and those which it has not expressly authorised) without giving a reason for doing so . Neversea has the right to determine the conditions of the demonstrations, in particular the number of participants, their location and duration, at its own discretion. If Neversea declares an end to a particular demonstration, participants are required to stop the demonstration immediately. If Neversea establishes conditions for an authorized or recognized demonstration as described above, participants are required to fully comply with those conditions.

13.8 In the Festival Area, the authorized and appropriately qualified employees of Neversea or its Contractual Partners, as well as the employees or collaborators of the Partners, will ensure the application of the rules of conduct and safety. Visitors expressly undertake, by virtue of their participation in the respective Festival, that they will fully cooperate with these persons within the limits of the law and will comply with their instructions during the Festival in case of emergency or if other significant circumstances (e.g. for reasons of public health) justifies it.

13.9 Both free Services and Products, as well as Services and Products for which a charge is made, can be used at the Festival 

the payment. Visitors agree to pay for all Services and Products for which payment is charged, and are responsible for the prompt payment of all purchase prices and fees due.

13.10 Visitors will pay for Products and Services for which payment is charged using the payment methods offered by Neversea or Contractual Partners. If Neversea so decides in relation to any area of ​​the Festival, all purchase prices and charges shall be payable exclusively by methods designated by Neversea, instead of cash. 

 

14. VIDEO SURVEILLANCE AND PERSONAL DATA PROCESSING

14.1 For security reasons, the Festival Area is monitored with video cameras by the Contractual Partners of Neversea. The processing of your personal data taken through the video surveillance cameras takes place whenever you are in the Neversea festival premises, and by participating in the Festival the Participant gives you explicit consent for this processing. Also, the concerts as well as the entire festival can be video/photo recorded by our contractual partners, for marketing and advertising purposes, as mentioned in the chapter. XV.

14.2 The categories of personal data processed, the means, the purposes of the processing, as well as the entire policy of Neversea regarding the processing of personal data can be found in the Privacy Policy of the Neversea Festival 2025 available in the Privacy Policy section.

14.3 According to EU Regulation 679/2016 (GDPR) you benefit from the right of access, rectification, the right to obtain data deletion or restriction of processing, the right to data portability, the right to opposition, the right not to be subject to a decision based exclusively on processing automatic.

14.4 To exercise these rights, you can address Neversea S.R.L with a written, dated and signed request to the address [email protected].

14.5 If you consider that your personal data is processed otherwise than in accordance with the applicable legislation, please contact us at the e-mail address [email protected] or you can contact the National Data Processing Supervisory Authority with Personal Character.

15. HEALTH AND SAFETY

15.1 Taking into account the scope of the Festival, the Organizer will take the appropriate measures, so that the Participants are informed about the prevention and protection measures and activities within the Festival Area. 

15.2 Each Participant has the obligation to show a civilized behavior towards the other Festival Participants.

15.3 To the extent that the Organizer considers that a Participant endangers the safety of other Participants or creates a situation of discomfort for them or behaves in a manner that affects the smooth running of the Festival or the atmosphere in the Festival, the Organizer reserves the right to cut off the bracelet that Participant and to request the assistance of the Gendarmerie or the security company to escort that Participant out of the Festival and not to allow him access back into the Festival. 

15.4 Government agencies, MAI institutions or other authorized bodies may give the Organizer negative advice regarding the access of a ticket and/or season ticket holder to the Festival. In this case, the Organizer is entitled to refuse entry to the event perimeter of the Buyer, and the latter will not have any right to compensation. 

 

16. RECORDINGS MADE WITHIN THE FESTIVAL

16.1 By purchasing a ticket and attending the Festival, the Product Buyer agrees to be photographed, filmed or recorded by the Organiser, the venue management or any third party operating on behalf of the Organizer within the Festival or in the immediate vicinity of the entrance to the venue . In addition, by purchasing a Product, the Product Purchaser consents to photographs, video or audio recordings of you at the Festival or in the immediate vicinity of the entrance to the venue ("Filmed Material") taken by the Organiser, venue management or any third party operating on behalf of the Organizer. You hereby agree that the Promoter, venue management or any third party acting on behalf of the Promoter may use the Recorded Material in any way they see fit without restriction, approval or reward for doing so.

16.2. The organizer has the image right over the entire Festival and can use the photo and video images, made both by its own staff and by the participants, in various materials made during the Festival.

16.3 Participants acknowledge that NEVERSEA, its contracted partners authorized by NEVERSEA, associations, members of the media, other visitors and other third parties may produce audio and visual recordings of the Festival. Therefore, Participants, by purchasing a Product and by virtue of their participation in the Festival, grant the Organizer permission to record and publish their image, appearance and actions in accordance with Article 16.1.

16.4 NEVERSEA and persons authorized by NEVERSEA have the unrestricted right to obtain profit, to use (in particular for the purpose of promoting the Festival), to copy, publish, publicly broadcast and distribute such recordings of Visitors, without being required to pay Visitors for this. 

16.5 Visitors expressly note that NEVERSEA may record the Festival, concerts and programs, copy the recordings and distribute them by image media, broadcast or otherwise make them public and may do so in a manner repeatedly, including by informing the public about the Festival, concerts and programs, by means of cable data transmission or by any other means (e.g. via YouTube), so that members of the public can individually choose the place and time of access. 

16.6 Visitors have no right, within the limits of the legal provisions, to raise claims against NEVERSEA in relation to their registrations and publication as provided above. 

16.7 Visitors may not, without the prior consent of NEVERSEA, sell, use in exchange for a price or use for free for commercial purposes, the image and voice recordings they have made, identify the Visitors appearing in those recordings without the consent them, or violate the personal rights of other Visitors. 

16.8 The organizer reserves the right to establish areas/locations where photography/filming is prohibited. In case of non-compliance, the Organizer has the right to delete the respective registrations.

 

17. LIMITATION OF LIABILITY AND FORCE MAJEURE

17.1 NEVERSEA does not offer any guarantee regarding the possibility to enter the Festival at the desired time or the possibility to attend the concert at the previously announced time and explicitly excludes the refund of the Product price, the granting of an additional discount or the payment of any damages or compensations as following these facts.

17.2 NEVERSEA recommends all participants to check-in online at the time of ticket purchase and to come to the Festival at least a few hours before the concert they wish to attend. 

17.3 NEVERSEA reserves the right to modify, restructure and further develop the Festival, Services and Products offered within the Festival, including but not limited to program changes (artistic, organizational, etc.), the location where the Festival takes place, at its discretion. Participants are not entitled to any claim against NEVERSEA in respect of such changes, restructuring or further developments. However, NEVERSEA will make every effort to provide the communicated programs and Services and, in the event that their provision becomes impossible, to replace the canceled program or previously communicated Service with another program or Service.

17.4 Therefore, NEVERSEA will not guarantee to the Visitor the availability, content, quality and quantity of programs and Services (such as the evolution or appearance on stage of a particular artist, the fact that the evolution of a particular artist will live up to the expectations of the Visitor, or the opportunity to to participate in a specific artistic program and/or at a specific location). These elements may take shape depending on the special characteristics of the location, the extraordinary situations involved and the equipment present within them (such as the number of seats of a certain location). 

17.5 NEVERSEA is under no obligation to cancel the Festival in case of bad weather, however, if the authorities request the suspension or closure of the Festival by NEVERSEA due to force majeure, the Festival or a part of it will be cancelled/suspended, and NEVERSEA cannot be held responsible for festival-goers or other third parties for its closure/suspension.

17.6 Participants expressly note that they may also purchase Products and Services in connection with the Festival that are offered by other Contractual Partners, and not by NEVERSEA. In such cases, the contract is concluded directly between the Visitor and the Contractual Partner, and the rights and obligations arising from the legal relationship apply exclusively to the Visitor and the Contractual Partner. 

17.7 NEVERSEA does not assume responsibility for damages arising from or suffered in connection with the purchase or use of Services and Products provided by Contractual Partners or for damages of any nature suffered by visitors as a result of participating in artistic moments or subsidiary activities within the festival. 

17.8 Visitors will enter the Festival exclusively at their own risk, being liable for damages suffered by them or caused to other participants in the Festival premises.

17.9 Lost and found items can be handed in at the information desk indicated on the map. Visitors can inquire about lost items at the same office. 

17.10 Participants are fully liable, both under civil and criminal law, for any damage they cause to NEVERSEA, its Contractual Partners and other Visitors and Third Parties within the Festival or in connection with the Festival. 

17.11 NEVERSEA is not responsible for damages that may occur outside the Festival Area or on the way to or from the Festival Area.

17.12 NEVERSEA has the right to immediately terminate the legal relationship with the Participant (having a Ticket or Wristband) who has violated any provision of these TCG in relation to the Festival. In such a case, NEVERSEA may invalidate the Participant's Ticket or remove the Participant's Wristband, and the Participant will be forced to leave the Festival. Also, NEVERSEA reserves the right to refuse the purchase of a new ticket by the respective festival-goer, for the entire duration of the festival, or in case he obtains a ticket to the Festival, to refuse his access to the Festival premises, without granting him any right to compensation. 

17.13 In addition to the immediate termination of the legal relationship with the Participant, NEVERSEA has the right to subsequently refuse his access to the Festival. 

17.14 The Participant agrees to be given the medical treatment that may be considered appropriate in case of injury, accident or illness during the Festival and fully exonerates NEVERSEA and all persons participating in the provision of the respective medical treatment from liability for any such actions. 

17.15 First aid and medical assistance services will be continuously provided in the Festival Area. NEVERSEA is not responsible for how these services are provided. 

17.16 During the Festival, there will be various high-intensity light games and pyrotechnic effects that can harm children or epileptics. 

17.17 Participants who suffer from mental or physical illnesses and who may be affected in any way by loud noises, special visual effects, crowded areas, special sound effects or any other such, assume full responsibility for the damages they may suffer. 

17.18 Likewise, the Organizer does not assume responsibility for any damages or injuries that may occur as a result of fireworks. Participants assume full responsibility for their ability to physically/psychologically participate in various activities within the Festival. 

IMPORTANT! We recommend carrying out specialized medical checks before participating in activities that require an increased level of effort.

17.19 NEVERSEA will not have any responsibility, of any nature, for any kind of damage (direct or indirect) resulting from the use or inability to use the information presented on the Site in connection with the Festival. NEVERSEA, without any prior notice, may delete, modify or add any information on the Site, suspend any activity on the Site, and in the event that references are made to other sites NEVERSEA does not guarantee and/or confirm in any way the type of information which can be found on these sites. 

17.20 NEVERSEA is also not responsible for the comments posted by users on the Site. Any information, data, text, photos, graphics, etc. contained on the Site are the responsibility of the person/entity from which it originates. Under these conditions NEVERSEA cannot guarantee the content of the Site including, but not limited to, truncated, incomplete or wrong information or for any consequences of their use. 

17.21 NEVERSEA makes no guarantees of any kind that the Site will operate uninterrupted, secure and error-free of any kind. The site may be discontinued by the owner or administrators at any time without any prior notice and without any claim of any kind from its users. 

17.22 The value of purchased tickets will not be refunded in the event of cancellation of the Festival by the Organizer due to force majeure or fortuitous circumstances. Force majeure or fortuitous event means any external and unforeseeable event such as, but not limited to: storms, threats or risk of terrorist attack, acts of public authorities, whether legitimate or not, epidemics, pandemics, accidents, explosions , fires, floods, torrential rains, earthquakes, social conflicts, major short circuit, high risk of health damage or any other cases that cannot be foreseen or removed through diligence and prudence by the Organizer.

17.23 Moving the venue of the event to the same geographical area is not a reason for the return of the ticket price. 

17.24 The dates of the festival can be changed unilaterally by the Organizer in case of force majeure or fortuitous event without any obligation to refund the price of the tickets to the Buyer. 

17.25 In the event of the death of the ticket holder, the Organizer of the event will refund the value of the paid ticket provided that the applicant presents supporting documents to prove the event (for example, death certificate). 

 

18. INTELLECTUAL PROPERTY RIGHTS  

18.1 Everything that is posted on the Site as well as on various types of supports in the Festival Area, such as, but not limited to, images, texts, graphic elements, symbols, logos, databases, etc.   is the property of Neversea and/or its Contractual Partners. All of this falls under intellectual property legislation.

18.2 Visitors and Third Parties may not use, copy, distribute, publish or incorporate in other documents or materials such markings/information in any form for the purpose of obtaining income without the express prior written permission of Neversea and/or its Contractual Partners.

18.3 The images, logos, texts of the Contractual Partners of Neversea belong to them and are reproduced on the Website or in the Festival Area with their consent.

18.4 Neversea will make every effort to identify messages it has received on the Site without having been addressed to it, by restoring the direct link to the source or by mentioning the persons appearing on this Site, but it will not always be able to guarantee the existence of the source reproduced.

 

19. PROVISION OF INFORMATION/ ATTEMPTS TO FRAUD

19.1 In order to use the Site, users of the Site agree to provide real information about themselves, as specified in the user registration section, and agree to provide this information correctly and completely.

19.2 Any attempt to provide false information, to access the personal data of another user, to modify the content of the Site or to affect the performance of the server on which the Site is posted, will be considered an attempt to defraud the Neversea systems and will leads to the immediate blocking of access to the Site's users. Neversea also reserves the right to notify the relevant authorities of this attempt.

 

20. PROMOTIONAL OFFERS, RAFFLES AND CONTESTS

20.1 Neversea, at its option, will establish the conditions for conducting promotions on the Site, in accordance with the law. Promotions, raffles and contests run for a limited period and expire automatically on the date mentioned for each promotion, raffle or contest.

20.2 Any promotion, raffle or competition may be discontinued or canceled at any time without any prior notice. However, all participants will be notified of such interruption or cancellation.

21. CONFLICTS

21.1 Any conflict arising between Neversea and its customers as a result of participation in the Festival or use of the Site will be resolved amicably. If this is not possible, the resolution of conflicts is the competence of the Romanian courts in Cluj-Napoca or Bucharest. 

21.2 The applicable law is Romanian law.

 

22. MISCELLANEOUS PROVISIONS

22.1 These Terms and Conditions, representing the Contract between the consumer and the Organizer, may be assigned by the latter without the client's consent being required. 

22.2. Chapter names and sub-headings are for reference only and are not to be considered in the interpretation or construction of these TCG. 

22.3. In the case of declaring any of the clauses of the present TCG null or unenforceable, the rest of the clauses will continue to produce their effects, and the clause declared null or unenforceable will be replaced by a new clause that reflects as closely as possible the will of the Organizer.
